The requirements for a Commercial EPC
If you’re leasing, selling, or building commercial properties, you will require a commercial EPC.
There are some situations that I do not need an EPC for more information
If a structure is divided into separate parts that have been ‘designed and altered for use for separate accommodation’ the components may require an EPC. The leasing and sale of commercial buildings is complicated due to multiple tenants and use.
If you require an individual or multiple EPCs could depend on the heating systems you have in place and the plans for the construction.
Find out what to do if I have an area that has been subdivided into distinct sections’ below, or call William Morris for free guidance on the most cost efficient solution for your building’s EPC needs.
What is the time when an EPC necessary?
An EPC must be made available to prospective buyers or tenant as soon as possible and not later than the time an inspection is scheduled and/or when written details are given regarding the building. Even if there is no marketing taking place, it should be made available prior to signing an agreement to let or sell.
What is the length of time the EPC Valid for?
A EPC has validity for a maximum of 10 years, until a more recent EPC is issued for the property in which case the older one is valid.
Do you know of any instances in which I don’t require an EPC?
EPCs are not required for the construction, sale or rental for:
churches;
temporary structures that have a plan period of use of less than two years
stand-alone (entirely isolated) structures with an area of floor space that is less than 50m2 and aren’t dwellings;
industrial locations, workshops and agricultural buildings that are not residential and have a little energy use;
to rent or sell properties that are due for demolition
What is the consequence if I don’t possess an Energy Performance Certificate?
The penalty for failure to provide an EPC accessible to any potential purchaser or tenant, when leasing or selling non-dwellings, is, in the majority of instances at 12.5 percent of the value at which the building is rated. property with the minimum fee in the amount of PS500 as well as a maximum penalty of PS5,000. There is the minimum penalty for default of PS750 when the formula is not able to be used. The EPC is still mandatory.
What happens if I own an apartment that has been subdivided into components?
Renting or selling an entire building requires the EPC for the entire structure. If the building contains parts made or modified to be used as separate units with different heating systems, it is also permitted to offer EPCs for the parts individually, and an EPC for communal areas.
Renting out a portion of building, if the building is heated by the same heating system as the rest of the building If the building is equipped with an common heating system then the prospective or the seller of the building landlord could make the EPC for the entire building or for the specific area that is designed or modified to be used as a separate unit (in which case communal zones are not taken into consideration).
Separate parts of a building and heating systems that are separate A separate EPC must be created (or provided) for each element of a structure that is being sold as a separate unit or lease. If the building is being sold or let as a entire structure, it is acceptable to offer EPCs for the parts, and one EPC for the communal areas that are heated or conditioned, or to provide an EPC for the entire building.
Housing: All residence that is self-contained requires an individual domestic EPC. Spaces that can only be reached via commercial spaces (i.e. the house has shops in a downstairs space or a store with an accommodation, where access is via the shop) will be evaluated with the commercial premises being one structure.
